Right Of Withdrawal

1. Right of withdrawal
The right of withdrawal is the consumer's right to withdraw from a distance contract within a specified period without giving any reason.
When purchasing goods from the SujLetak.lv online store, the consumer has the right to exercise the right of withdrawal within 14 days.
When goods are purchased, the 14-day withdrawal period begins on the day on which the consumer, or a third party indicated by the consumer other than the carrier, takes possession of the goods.
If several goods are ordered in a single order and are delivered separately, the period begins on the day on which the last item is received. If the goods are delivered in several lots or parts, the period begins on the day on which the last lot or part is received.
The right of withdrawal applies to consumers — natural persons who purchase goods for purposes unrelated to their business or professional activity. The statutory consumer right of withdrawal does not apply to legal entities.
2. Exercising the right of withdrawal
To exercise the right of withdrawal, the consumer must inform the seller of their decision to withdraw from the contract before the end of the 14-day period.
This may be done by sending a completed withdrawal form or any other clear statement indicating the consumer's decision to exercise the right of withdrawal.
Use of the withdrawal form is not mandatory — the consumer may also submit a free-form statement from which the intention to withdraw from the distance contract is clearly evident.
The withdrawal period is considered to have been observed if the notice of withdrawal is sent before the expiry of the 14-day period.
If necessary, the consumer is responsible for proving that the notice of withdrawal was sent within the prescribed period.
3. Returning the goods
After sending the notice of withdrawal, the consumer must return or hand over the goods to the seller without undue delay and no later than within 14 days.
The deadline is met if the goods are sent back before the end of the 14-day period.
The consumer bears the direct costs of returning the goods to the seller, unless the seller has agreed to bear those costs.
When returning the goods, the consumer must ensure that they are packed appropriately for their characteristics and the method of transport so that the goods are not damaged during transportation.
4. Inspection of the goods and reduction in value
During the withdrawal period, the consumer has the right to inspect and test the goods to the same extent as would be possible in a physical shop in order to establish the nature, characteristics and functioning of the goods.
The consumer is liable for any reduction in the value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.
Opening the original packaging of the goods does not in itself deprive the consumer of the right of withdrawal, except in cases specified by applicable law. However, we recommend opening the packaging and handling the goods carefully in order to avoid any unnecessary reduction in the value of the goods or their accessories and components.
5. Refund
If the consumer exercises the right of withdrawal, the seller shall refund all payments received from the consumer, including the initial delivery costs, without undue delay and no later than within 14 days from the day on which the seller receives the consumer's notice of withdrawal from the contract.
If the consumer has chosen a delivery method that is more expensive than the least expensive standard delivery method offered by the seller, the seller is not required to reimburse the additional delivery costs.
The seller is entitled to withhold the refund until the goods have been received back or until the consumer has provided evidence that the goods have been sent back, whichever occurs first.
The refund will be made using the same means of payment that the consumer used for the original transaction, unless the consumer has expressly agreed to a different method of reimbursement.
6. Cases in which the right of withdrawal does not apply
In cases specified by applicable law, the consumer may not exercise the right of withdrawal. In particular, the following exceptions may apply to goods offered by SujLetak.lv:
- the goods have been made to the consumer's specifications or are clearly personalised;
- the consumer has opened the packaging of goods which are not suitable for return for health protection or hygiene reasons once the packaging has been opened;
- the consumer has opened the packaging of computer software, audio recordings or video recordings;
- the supply of digital content not supplied on a tangible medium has begun after the consumer has given prior express consent for the supply to begin during the withdrawal period and has acknowledged that this results in the loss of the right of withdrawal;
- the provision of a service has been fully completed after performance began during the withdrawal period with the consumer's express consent and the consumer acknowledged in advance that the right of withdrawal would be lost once the service had been fully performed.
7. Withdrawal form
The SujLetak.lv withdrawal form may be used to exercise the right of withdrawal, but its use is not mandatory.

8. Additional information
Exercising the right of withdrawal does not affect the consumer's statutory rights in cases where the goods received do not comply with the terms of the contract.
