1. Consumer rights

The seller is responsible for ensuring that the goods sold comply with the terms of the contract and are suitable for their intended purpose.

The consumer is entitled to submit a claim to the seller regarding the non-conformity of goods with the terms of the contract within two years from the date of delivery of the goods. A claim regarding the identified non-conformity must be submitted to the seller no later than within two months from the date on which the consumer discovered the non-conformity.

If the non-conformity of the goods with the terms of the contract becomes apparent within one year after delivery, it shall be presumed to have existed at the time of delivery, unless such a presumption is incompatible with the nature of the goods or the type of non-conformity identified.

2. Consumer remedies in the event of non-conforming goods

If the purchased goods do not comply with the terms of the contract, the consumer is initially entitled to request:

  1. the non-conformity of the goods to be remedied free of charge; or
  2. the goods to be replaced with goods that comply with the terms of the contract.

The repair or replacement of the goods shall be carried out free of charge and within a reasonable period of time, without causing significant inconvenience to the consumer.

The consumer is entitled to request a proportionate reduction in the price of the goods or termination of the contract and a refund of the amount paid for the goods in the cases provided for by applicable legislation, including where the seller has failed to remedy the non-conformity or replace the goods within a reasonable period of time, the non-conformity remains after an attempt to remedy it, or the non-conformity is sufficiently serious to justify an immediate price reduction or termination of the contract.

The consumer's statutory rights apply independently of any commercial guarantee provided by the manufacturer or the seller.

3. Guarantee

In addition to the consumer rights provided by law, a manufacturer or seller may provide a commercial guarantee for certain goods.

The commercial guarantee period for the goods offered by us may be 24 or 36 months from the date of purchase, depending on the specific manufacturer and product. The exact guarantee period and its terms are determined in accordance with the guarantee conditions of the manufacturer of the specific product.

During the guarantee period, where a fault is covered by the guarantee terms, the necessary replacement of spare parts and repair work will be carried out free of charge.

The guarantee covers manufacturing defects and faults arising during normal use of the goods in accordance with the manufacturer's instructions.

The guarantee does not limit the consumer rights provided for by the Consumer Rights Protection Law.

4. Cases in which guarantee repair may not apply

Guarantee repair may not apply:

  1. if the commercial guarantee period applicable to the relevant product has expired;
  2. if the fault has arisen as a result of mechanical damage, liquid ingress or other external circumstances;
  3. if the fault has arisen as a result of using the product contrary to the operating instructions or the manufacturer's guidance;
  4. if the fault has arisen as a result of improper maintenance, the use of unsuitable cleaning agents or other materials not intended for the product;
  5. if the product has been improperly repaired, modified or altered and such actions have caused the specific fault;
  6. if the fault has arisen as a result of force majeure, a natural disaster, fire, flooding, overvoltage, an accident or other external circumstances.

5. Parts subject to normal wear and tear

The commercial guarantee generally does not cover parts and materials that are subject to natural wear and tear during normal operation of the equipment, such as needles, bobbins, hooks, belts, light bulbs, needle threaders, overlock knives and other regularly replaceable or wearing parts, unless the failure of the specific part has been caused by a manufacturing defect.

6. Equipment diagnostics

If the fault reported by the customer cannot be identified in equipment submitted for guarantee repair, or if it is determined that the fault is not covered by the terms of the commercial guarantee, a diagnostic fee may be charged in accordance with the applicable service price list.

The customer will be informed of any potential charge before a paid service is carried out.

7. Preventive maintenance

To ensure the safe and proper operation of the equipment, the manufacturer's maintenance requirements must be followed, for example regular cleaning of the sewing machine and, where required for the specific model, lubrication.

If equipment submitted for guarantee repair requires preventive maintenance that is unrelated to the fault being remedied under the guarantee, such maintenance may be carried out for an additional charge after the customer has been informed in advance.

8. Territorial scope of the guarantee

The territorial scope of the commercial guarantee is determined by the guarantee conditions of the manufacturer of the specific product or the guarantee provider.
